A Policy Governing the Use of David King Tryon Skate Park

 

SECTION 1                AUTHORITY

1.1         The Board of Selectmen hereby adopts this policy pursuant to the provisions of RSA 41:8 and 41:11-a; whereby the use of Town-owned property shall be subject to the requirements and limitations as set forth herein.

 

SECTION 2                PURPOSE

2.1           This policy is established to provide for the safety of those using the David King Tryon Skate Park (hereinafter referred to as ‘Facility’). 

 

SECTION 3                ADDITIONAL REGULATIONS

3.1            This policy is intended to serve as a supplement to the Policy Governing the Use of Town Property adopted by the Northfield Selectboard on June 22, 2010 as it may be amended by the Northfield Selectboard. 

 

SECTION 4                RULES REGARDING USE

4.1    The Facility shall only be used between the hours of dawn to dusk when weather conditions permit.

 

4.2    Helmets must be worn by those using the Facility.  Gloves, knee and elbow pads, wrist supports and proper shoes are recommended but are not required.

 

4.3    Persons using the Facility do so at their own risk.  Users are advised to be aware of their ability level and skate accordingly.

 

4.4    Standing on decks without skates or skateboards is not allowed.

 

4.5    Tagging, defacing park property and actions of vandalism are not permitted.

 

4.6    Persons using the facility shall remain attentive of their surroundings by being continually aware of other users, loose or flying objects and other items that may pose hazards.

 

4.7     Alcohol, illegal substances, foul language, and loitering are prohibited at the David King Tryon Skate Park.

 

4.8    Pets, glass containers and littering are prohibited at the David King Tryon Skate Park.

 

SECTION 5                LIABILITY

5.1    As per RSA 507-B:11 in the absence of gross or wanton negligence the Town is not liable for personal injury or property damage resulting from a person’s use of the Facility for the purpose of skateboarding, rollerblading, stunt biking or rollerskiing.

 

SECTION 6                ENFORCEMENT

6.1    Any person found to have been in violation of this policy may be denied permission to use Facility by any Northfield Selectboard member, the Police Chief, Highway Superintendent or Town Administrator.

 

6.2           Any Northfield Selectboard member, the Police Chief, Highway Superintendent or Town Administrator has the authority to close the Facility if, in their judgment, the Facility may not be used safely due to adverse weather conditions, maintenance issues or other condition that would prohibit its safe use.

 

6.3           Any Northfield Selectboard member, the Police Chief, Highway Superintendent or Town Administrator has the authority to close the Facility if they have reasonable cause to believe that the Facility is not being used in a manner consistent with the rules included in Section 4 of this policy.

 

6.4           If the Facility has been closed under the provisions of Section 6.2 or 6.3 it shall not be reopened unless the Police Chief and Highway Superintendent or their designees concur that the circumstances that lead to the closing of the facility have been addressed and the facility will be used in a safe and respectful manner.
